Personal Injury Case Steps

Step One: Treating

You are currently going to the Doctor and obtaining treatment for your injuries. Not only is receiving treatment the right thing to do for your health but, if you do not obtain treatment for some time following your accident, the insurance adjuster and a jury will assume that you were not hurt. Thus, if you are still experiencing pain, it is imperative you obtain consistent care. Please keep me updated as to your treatment and send me a message if you are released from treatment and/or you are having issues in obtaining the necessary care. I hope you feel better soon.

Step Two: Released

You have reached MMI (Maximum Medical Improvement), have ended your medical treatment, and have recovered to the best position that you are going to be. If you have not reached MMI, please notify me as soon as possible so that we can discuss the best course of action. Also, please notify me if you obtain additional care after you are released considering it is imperative that we have all of the records and bills related to your injuries.

 

Considering you are released, my office has requested your medical records and bills, and we are waiting for all documentation to arrive. Generally, it takes roughly thirty to sixty days to receive medical records and bills from providers. My office is following up on these requests, and I will notify you as soon as all documentation is received.  

Step Three: Attorney Review

The good news, we have received all of your medical records and bills! I am currently reviewing all of the documentation and am putting together a demand package that will be submitted to the insurance company. I will notify you if I need additional documentation and/or information regarding the facts of this accident, your injuries, and/or your treatment. As soon as the demand package is finalized, we will submit it to the insurance company. We will move as efficiently as possible, and from there we will be in the negotiation stage.   

Step Four: Negotiation

The demand package has been submitted to the insurance company. Generally, it takes roughly four to five weeks to hear back. As soon as we hear from the insurance company, we will give you a call. Our hope is that we will obtain a strong offer and resolve the case in short order.  However, depending on the initial offer, we will need time to negotiate with the insurance company to obtain the best result possible. I will notify you of the initial offer and all subsequent offers in order to discuss a resolution. 

Step Five: Settled

Good news, your case has settled! We are waiting on receipt of the settlement check at this time. In the interim, my office has requested reductions on your outstanding medical bills, and we are resolving any and all health insurance liens.  We will call you as soon as we receive the check and have finalized the numbers. We will do this as quickly as possible so that we can disburse your settlement funds and pay outstanding bills and liens.

Step Six: Escrow

We have released your settlement funds to you but are still waiting to finalize a few remaining balances. As soon as we finalize these balances, we will pay the amount owed and tender any remaining amount to you. Upon resolution, your case will officially be closed.
